Residence permit processing time: the 15-working-day receipt and your status while the passport is held

The official texts do not promise a delivery date. They set ceilings: the Law gives the exit and entry administration of the public security organ 15 days from the date of receipt to examine a residence permit application and decide it, and the Regulations cap the acceptance receipt at a period not exceeding 15 days, with the decision due inside that receipt's validity. The Administration's own service guide states the same ceiling as 15 working days from the date of acceptance. That is the whole of what the rules give you — a latest date by which a decision must exist, not an estimate of what any one office takes.

The receipt is the clock you actually hold

In practice the two numbers sit at different points. The Law's 15 days runs from the date the authority receives the application. The Regulations and the service guide work from the acceptance receipt: once the application is accepted, the office issues a receipt, and the decision on whether to issue the permit has to come within the receipt's validity — a period the Regulations put at no more than 15 days and the service guide expresses as no more than 15 working days from acceptance.

One discrepancy is worth stating plainly rather than smoothing over. The counting rule in Article 36 is written for the periods "in these Regulations", and the Regulations' Article 18 period is the 15 days. The Law's Article 30 says 15 days without that qualification, and the supplied text does not say how the Law's period is counted. Only the service guide, in both its Chinese and English versions, states a figure in working days.

If something is missing

Both the Regulations and the service guide require the office to tell you once, not in stages.

  • The authority is to notify the applicant, in a one-off manner, of the procedure to be followed and the material to be supplemented or corrected (Regulations, Article 18; service guide, Section VII.2).
  • The service guide adds that materials are to be collected completely at one time and the review done at one time (Section VII.2).
  • Under Section VII.3, the authority verifies the application through interview, telephone inquiry or on-site investigation, and confirms the applicant's foreign nationality. If an applicant fails to attend a scheduled interview without justification, the authority may decide not to issue.

Neither text gives a time limit for how long you have to supply the missing document, or says what happens to the receipt while you do.

Your status while the passport is with the office

This is the answer most students are looking for. Article 18 of the Regulations states that during the period when the applicant's passport or other international travel documents are retained for processing the residence permit application, the applicant may reside in China legally on the strength of the receipt of acceptance.

So the receipt is not a placeholder note. It is the document that carries your lawful stay for the window in which you have no passport and no permit. Keep it, and carry it. The texts supplied do not say anything about travelling outside mainland China during that window or about re-entering without the passport.

Collecting the permit

Section X of the service guide states that an approved residence permit must be collected in person by the applicant, who presents the acceptance receipt at the exit and entry administration of the public security organ. Article 30 of the Law separately requires applicants to submit biometric identification information such as fingerprints with the application, and the service guide's Section VII.1 requires the application to be made in person, with an exception for high-level and urgently needed talents, applicants under 16 or over 60, and those whose illness or other reasons make travel difficult — for those, the inviting entity or individual, a relative, or a specialised service agency may apply on their behalf.

What the texts do not say

The documents set ceilings and procedure. They do not state how long exit and entry offices in fact take, whether any office decides faster than the ceiling, how long an interview or verification step adds, or how the 15-day and 15-working-day figures interact if an office accepts an application and issues a receipt on different dates. The official materials supplied here are silent on all of that, and this page does not fill the gap with practice, rumour or another country's rules.

Questions people ask

Is the 15-working-day period a promise of when I will get my permit?

No. It is the maximum the texts allow for the decision. The Regulations say the decision must be made within the receipt's validity and the receipt may not exceed 15 days; the service guide states the same limit as 15 working days from acceptance. Neither text commits an office to finishing sooner.

Does the period include weekends and public holidays?

Not under the Regulations. Article 36 states that the period for examination and approval and the validity of the receipt are calculated in working days, excluding legal holidays. The Law's Article 30 does not carry that qualification in the text supplied.

Can I stay in China while my passport is being kept by the office?

Yes, on the strength of the receipt. Article 18 of the Regulations says the applicant may reside in China legally during the period when the passport or other international travel documents are retained for processing the residence permit application.

What happens if my application is incomplete?

The authority must notify you in one go. Article 18 of the Regulations and Section VII.2 of the service guide both require a one-off notification of the procedure to follow and the material to supplement or correct. No time limit for your response is given in the supplied texts.

How soon after arriving do I have to apply?

Within 30 days of entry, if your visa requires you to apply for a residence permit after entry. Article 30 of the Law states the 30-day period and the place of application: the exit and entry administration of the public security organ under the local people's government at or above county level for your intended place of residence.

Do I collect the permit by post?

The service guide states collection in person. Section X requires the applicant to go to the exit and entry administration of the public security organ with the acceptance receipt to collect the issued permit.
