Residence Permit for Study in China: What to Do in Your First 30 Days

In one line: if you entered on an X1 visa, apply for a residence permit for study within 30 days of the day you entered. Apply in person at the exit-entry administration of the public security organ where you live, with your passport, a photo and a letter from your school stating how long you will study.
The 30-day deadline
Article 30 of the Exit and Entry Administration Law says that where a visa specifies that a residence permit is needed after entry, the holder shall apply within 30 days from the date of entry. The Ministry of Education's rules for schools repeat it for students: an international student whose study visa says a residence permit is required applies for a study-type residence permit within thirty days of entry (Order No. 42, Article 36).
The count starts at entry, not on the first day of class and not on the day the visa was issued.
Where and how to apply
- Office. The exit-entry administration of the public security organ of the local government, at or above county level, in the place where you will live (Law, Article 30).
- In person. You go through the formalities yourself and give biometric information such as fingerprints (Regulations, Article 16).
- Papers. A valid passport, the application form with one photo that meets the photo standard, and material for the purpose of residence. For study, the National Immigration Administration's service guide asks X1 holders for a letter from the school stating the study period and proof of admission or enrolment. It adds that paper copies can be waived when the information has already been registered in the national study-in-China management information system.
- Health certificate. For a permit valid for more than one year, a health certificate is required, and a certificate is valid for six months from its date of issue (Regulations, Article 16).
How long it takes and how long it lasts
The office issues a receipt of acceptance valid for no more than 15 days and decides within that period. While it holds your passport, you may reside in China legally on the strength of the receipt (Regulations, Article 18). Periods in the regulations are counted in working days (Article 36).
The service guide says a study permit can be issued for a period that matches the study period the school states. The law sets the outer limits for non-work permits: at least 180 days, at most five years (Article 30).

Frequently asked questions
Can I travel while my passport is with the exit-entry office?
The regulations say you may reside in China legally on the receipt of acceptance. They do not say the receipt can be used to leave and re-enter China, so plan trips abroad for after the permit is issued.
What if my passport changes after the permit is issued?
The passport number is a registered item on the permit. When a registered item changes, apply to update the permit within 10 days (Law, Article 33). Not doing so can bring a warning and a fine of up to RMB 2,000 (Law, Article 76).
When should I renew?
Apply within the 30 days before the permit expires (Law, Article 32).
Does my school apply for me?
The general rule is that you apply in person. Your school supplies the letter about your study period, and many schools organise the visit, but the application is yours.
