A residence permit for study is issued to match the study period your school states in its letter. The Law fixes the outer limits for a non-work-type permit: at least 180 days and at most five years (Law, Article 30). If your course runs longer than the permit you hold, you apply for an extension in the 30 days before the permit expires (Law, Article 32).
Nothing in the official texts sets a standard one-year permit. Where they are silent on a point, this page says so rather than filling the gap.
What the study period is taken from
The National Immigration Administration's service guide for residence permits lists study as a category of permit. For a person who entered on an X1 visa, the applicant submits a letter from the school stating the study period, together with admission or enrolment proof; if the relevant information has already been registered through the national management information system for studying in China, the paper materials may be waived. A person who entered on another type of visa must also submit proof issued by the competent department. The guide then says a residence permit consistent with the study period stated by the school may be issued. The guide is published in Chinese; the English wording here is this site's own translation.
So the school's letter is the anchor, and the Law's 180-day minimum and five-year maximum are the boundaries around it. The texts do not say what happens if a school states a period shorter than 180 days.
Who the permit is for
The Regulations divide residence permits into five types, and the residence permit for study is the one issued to persons who pursue long-term studies in China (Regulations, Article 15(2)). The Law itself speaks of foreigners generally; it does not name students in Article 30.
If the course outlasts the permit
Apply to the exit-entry administration of the public security organ at or above the county level in the 30 days before the permit expires, and submit the information required for the specific application matter. Where the reasons for extension are appropriate and sufficient, an extension is granted; where it is denied, the holder must leave China when the permit expires (Law, Article 32).
Getting the permit in the first place
Where your visa states that you must apply for a residence permit after entry, you apply within 30 days of the date of entry, submitting your passport or other international travel document, the information required for the application, and biometric identification such as fingerprints. The exit-entry administration examines the application and decides within 15 days of receiving it (Law, Article 30).
Questions people ask
Is a study residence permit always issued for one year?
The official texts do not say that. The service guide says a permit consistent with the study period the school states may be issued, and the Law gives only the 180-day minimum and five-year maximum for a non-work-type permit.
Can the permit be extended if my course is longer?
Yes, the Law provides for it: apply in the 30 days before expiry, and an extension is granted if the reasons are appropriate and sufficient; if it is refused, you leave when the permit expires (Law, Article 32).
How long does the decision take?
