After graduation in China: the residence permit facilitation measures the immigration authority lists for graduates

No. Graduating does not by itself give you a new basis to stay in China. The school that admitted you must report that you have graduated or completed your course to the exit and entry administration of the public security organ at or above the county level (Regulations, Article 26), and the Law requires a foreigner to leave China prior to the expiry of the prescribed duration of stay or residence (Law, Article 37). Staying on after the course therefore depends on a new permission, not on the fact that you finished.

What exists for graduates is a set of facilitation measures printed in the National Immigration Administration's own English service guides, both dated 1 April 2021. They let certain graduates apply for a residence permit; they do not create an automatic one.

The baseline: three rules that apply regardless of the facilitation measures

Your study residence permit is tied to being an admitted student. Once that ends, three rules from the Law and the Regulations govern what happens next.

  • The school reports the change. Under Regulations, Article 26, the entity that admits a foreign student must report in a timely manner when the student "has graduated, completed his or her course(s) or study, has quit school, or has left the school ungraduated."
  • You leave before the permitted duration expires. Law, Article 37: foreigners "shall not engage in activities not corresponding to the purpose of stay or residence, and shall leave China prior to the expiry of the prescribed duration of stay or residence."
  • Work needs its own permission. Law, Article 41: "Foreigners who work in China shall obtain work permits and work-type residence permits in accordance with relevant regulations," and no entity or individual may employ a foreigner who has neither. Article 43 defines unlawful employment to include working without those documents and, for foreign students, working beyond the scope of jobs or the time limit prescribed under the rules on foreign students working to support their study. Article 42 says the education department under the State Council, together with other departments, is to establish that administrative system and set the job scope and time limits; the text of the Law itself does not contain those limits.

What the service guides list for graduates

Two pages of the National Immigration Administration carry the measures: the service guide on residence permits for foreigners, in section VI, items e and f; and the service guide on visa extension, change and reissuance for foreigners, in section VI, item 6, sub-paragraphs a, b and c. Both are the Administration's own English pages dated 1 April 2021.

The two pages do not describe the same document in the same words. The residence permit guide says only "residence permits valid for 2-5 years" and "residence permits valid for no more than 2 years", without naming a permit category. The visa guide calls both a "residence permit for private affairs" marked "entrepreneurship". This page reports both wordings; neither guide reconciles them.

The same section of the visa guide also lists a third facilitation measure, for students from overseas institutions of higher learning who are invited to intern in China by well-known Chinese enterprises and public institutions (item 6c): a private-affairs visa valid for one year, noting "internship", on a letter from the inviting entity and a study certificate from the institution. That measure is aimed at students of institutions outside China and is outside the question this article answers.

What the pages do not say

The gaps matter as much as the measures, because they are the parts applicants most often assume are settled.

Neither page defines "key universities in China", "key Chinese institution of higher learning", or "internationally renowned universities". Neither page says what counts as proof of innovation activities or business start-up, or who assesses it. The measures themselves (item e and f of the residence permit guide; item 6 of the visa guide) state no separate application procedure, processing time, fee, or list of offices where they are applied; each guide prints its general sections on procedure, time limit and charging elsewhere. Where the residence permit guide and the visa guide differ in wording, neither page states which governs.

The pages are dated 1 April 2021, so this article reports what those pages listed as of their date. Nothing in the Law or the Regulations turns these measures into an entitlement: Law Article 37 still sets the departure rule, and Law Article 41 still requires a work permit and a work-type residence permit before you work. For that reason this article does not call any of it a post-study work visa — the term does not appear in the Law, the Regulations or either service guide, and none of them establishes a general right to remain after graduation.

Where this leaves your planning

Read your own permit's expiry date first, because that date is the one Law Article 37 refers to. Then ask the exit-entry office that handles your case which of the measures on these pages it accepts, what documents it requires, and whether the private-affairs wording or the general residence-permit wording applies to your situation. If you are considering work and the changes that come with it, the work-type route runs through the work permit required by Law Article 41, not through the graduation measures.

Questions people ask

Can I stay in China after I graduate?

Only on a new basis. Regulations Article 26 requires the school to report that you have graduated, and Law Article 37 requires a foreigner to leave before the prescribed duration of stay or residence expires. The service guides dated 1 April 2021 list measures that let some graduates apply for a residence permit, but nothing in the Law, the Regulations or the guides makes staying automatic.

Is there a post-study work visa?

The term does not appear in the Law, the Regulations or either service guide. Working in China requires a work permit and a work-type residence permit under Law Article 41, and the graduation measures in the service guides are separate listed facilitation measures rather than a general post-study route.

Which universities count as "key" or "internationally renowned"?

The pages do not say. The residence permit guide and the visa guide use both terms without defining them, and neither the guides, the Law nor the Regulations provides a list or a criterion.

How long can the permit be?

The residence permit guide says 2–5 years for graduates of key Chinese universities engaged in innovation or start-up, and no more than 2 years for graduates of internationally renowned universities who come within two years of graduation. The visa guide gives the same two durations for a private-affairs permit marked "entrepreneurship".

Do I need my school to do anything?

Yes, and it is not optional. Under Regulations Article 26 the school must report in a timely manner once you graduate, complete your course, quit school, or leave ungraduated.
