How long can you stay on an X2 visa: the duration of stay and how it is counted

Unofficial summary · Sources checked

The number of days you may stay on an X2 visa is the duration of stay printed on your own visa, and it applies to each entry separately. The Regulations define the duration of stay as the period of time during which the visa holder is allowed to stay in China after each entry, and it begins from the next day of entry (Regulations, Article 36(3)). The "enter before" date on the same visa is about entry, not about how long you may stay: as long as you enter China before the expiry date of the visa, you may stay for the full length of the duration of each stay allowed by the visa (Embassy of the PRC in the United Kingdom, Part Seven, Q15). You must leave before that duration runs out (Law, Article 37).

Three separate fields on the visa, and only one of them is about stay

A visa carries a validity period, a number of entries, and a duration of stay. They do different jobs, and mixing them up is the most common reason people misread their own visa.

Field What it governs Text
Validity period of entry ("enter before"; shown as "expiry date" on a biometric visa) The period during which you may enter China. Unless the issuing authority specifies otherwise, a visa is valid from the date of issuance until Beijing time 24:00 on the expiring day, so long as the entries have not been used up Regulations, Article 36(2); Embassy Part One
Entries The number of times you may enter China within that validity period Regulations, Article 36(1)
Duration of stay The time you are allowed to stay in China after each entry, beginning the next day of entry Regulations, Article 36(3)

The UK embassy's Part One page describes all three in the same way, and adds that when the entries are all used up the visa is no longer valid, and that even with unused entries the visa is not valid if its validity has already expired. In either case, it says, the holder should apply for a new visa for another visit.

How the count actually starts

Day one is the day after you arrive, not the day you land (Regulations, Article 36(3)). The same definition appears on the UK embassy page: the duration of stay begins from the next day of entry.

Because the duration runs "after each entry", a later entry on a multiple-entry visa starts its own count. That only works while the visa still has entries left and is still within its validity period; once either is exhausted, the visa has no further use.

The 180-day ceiling, and what the texts do not say

The Regulations define short-term as staying in China for a period not exceeding 180 days, including 180 days, and long-term or resident as exceeding 180 days (Regulations, Article 36(4)). The Law, for its part, addresses visas whose duration of stay does not exceed 180 days, and says the holder may stay in China within the duration specified in the visa (Law, Article 29).

Neither text states a typical number of days for an X2 visa. This page will not supply one: the figure is whatever is printed on your visa as the duration of stay, and the official texts give only the 180-day line between short-term and long-term.

If you need more days than the visa gives you

An extension does not happen on its own; it exists only as an application. Under the Law, where the duration of stay needs to be extended, the holder must file an application with the exit/entry administration of the public security organ under the local people's government at or above the county level in the place of stay, seven days before the duration specified in the visa expires, and submit the information required for the application (Law, Article 29). If the reasons are found appropriate and sufficient, the extension is granted; if it is denied, the foreigner must leave China when the duration expires. The accumulated length of an extension may not exceed the original duration of stay specified in the visa (Law, Article 29).

The UK embassy's FAQ gives the same practical direction in one line: if you hold an ordinary visa and need to extend your stay after arrival, you apply to the local public security authorities before your duration of stay runs out (Part Seven, Q11). That page is written for applicants in the UK and is that embassy's guidance, not a rule issued for all missions.

If you stay past it

The Law requires foreigners who stay or reside in China to leave before the prescribed duration of stay or residence expires, and not to engage in activities that do not correspond to the purpose of stay or residence (Law, Article 37). The UK embassy's Part One page states that overstaying violates the Exit and Entry Administration Law, the Regulations and other relevant laws and regulations, and could result in a fine or other penalty.

Separately, foreigners aged 16 or over who stay or reside in China must carry their passport or other international travel document, or their stay or residence permit, and accept inspection by public security organs (Law, Article 38).

X2 and the 30-day residence permit rule

The UK embassy's FAQ lists the D, J1, Q1, S1, X1 and Z visas as the ones whose holders, when the duration of stay is shown as 000 days, must apply to the local public security authorities for a residence permit within 30 days of entry, with failure to do so counting as illegal overstay (Part Seven, Q11). X2 is not named in that list. If you are weighing the two student categories against your programme length, see the site's page on X1 or X2.

Questions people ask

Does the expiry date on my visa tell me when I have to leave?

No. That date is the "enter before" date, which sets the window for entering China. The embassy's answer is that entering before the expiry date lets you stay for the full length of the duration of each stay allowed by the visa (Part Seven, Q15). The Regulations describe the same field as the validity period of entry, running to Beijing time 24:00 on the expiring day unless the issuing authority says otherwise (Regulations, Article 36(2)).

Can I get more days than the number printed on the visa?

Only by applying. You apply to the exit/entry administration of the public security organ at or above county level in the place where you stay, seven days before the duration expires, and the extension is granted only if the reasons are found appropriate and sufficient; the total extension cannot exceed the original duration (Law, Article 29).

How many days do X2 visas normally give?

The Exit and Entry Administration Law and the Regulations do not state a typical figure for X2. They define the duration of stay as whatever is specified in the visa, counted from the day after each entry (Regulations, Article 36(3)), and draw a line at 180 days between short-term and long-term (Regulations, Article 36(4)).

Do I have to leave and come back to start a new count?

A new entry starts a new duration, because the duration of stay is defined as the time allowed after each entry (Regulations, Article 36(3)). But a further entry is only possible while the visa still has unused entries and its validity period has not expired; the UK embassy page states that a holder whose entries are used up, or whose validity has expired, needs a new visa.

Where do I find my own number?

On the visa itself, in the duration of stay field. Nothing on this page replaces it, and no general figure applies in its place.
