X2 visa and work or internships: why the work-study route is closed to short-term students

No. Paid work-study or an internship you arrange yourself runs through an endorsement on a study-type residence permit, and an X2 holder does not have one. Under the Regulations on Administration of the Entry and Exit of Foreigners, Article 22 gives that route to a foreigner "holding a residence permit for study": with the school's approval, the holder applies to the exit and entry administration authority of the public security organ to have the location and duration of the work-study or internship placement specified in the residence permit, and the second paragraph of Article 22 states that a holder shall not engage in off-campus work-study or internship unless that information is specified.

What the 2021 work-study measures require

The Measures for the Administration of Work-Study by International Students at Higher Education Institutions (教外厅〔2021〕2号) apply to higher education institutions that provide degree education (Article 2). The English wording of the Chinese documents below is this site's translation.

For off-campus work-study, Article 9 sets these basic conditions:

  • at least 18 years old and physically fit for the post;
  • holding a valid study-type residence permit in China, with more than six months of remaining validity;
  • observing Chinese laws and school rules, with good conduct and no record of crime or of violations;
  • having studied continuously at the current school for more than one year, as an associate-degree or bachelor's student, a postgraduate, an advanced student or a research scholar;
  • academic progress and attendance meeting the school's requirements; and
  • any other conditions the school sets.

Article 11 then requires the student to take the agreement and the school's letter to the exit and entry administration authority in the school's locality within ten days and have the work unit, period and other work-study information endorsed on the residence permit; a residence permit without that endorsement may not be used for off-campus work-study. Article 5 sets the time limits: in principle no more than 8 hours a week and 40 hours a month, and during winter and summer vacations in principle no more than 16 hours a week and 80 hours a month. Article 12 confines work-study to the prefecture-level city where the school is located and caps each approved period at the validity of the study-type residence permit, and at one year at most. Article 4 requires each school to make its own implementing rules, so the school's rules decide the details.

Why an X2 holder cannot meet those conditions

The X2 visa is issued to persons who apply for short-term study in China and the X1 visa to those who apply for long-term study (Regulations, Article 6(11)). "Short-term" means staying in China for a period not exceeding 180 days, including 180 days, while "long-term or resident" means residing for more than 180 days (Regulations, Article 36(4) and (5)). Order No. 42 of the Ministry of Education, the Ministry of Foreign Affairs and the Ministry of Public Security draws the same line in Article 45: short-term study is study at a school in China for not more than 180 days inclusive, long-term study is more than 180 days.

A residence permit for study is issued to persons who pursue long-term studies in China (Regulations, Article 15(2)). An X2 holder has a visa, not a residence permit, and the stay runs on the duration of stay in the visa: where that duration does not exceed 180 days, the holder may stay within it, and under the Exit and Entry Administration Law, Article 29, an extension must be filed seven days before expiry and the accumulated extension shall not exceed the original duration of stay. So the two Article 9 conditions that depend on status — a study-type residence permit with more than six months remaining, and more than a year of continuous study at the current school — cannot be satisfied on an X2. Article 22 of the Regulations addresses only the holder of a residence permit for study; it does not mention X2 visa holders.

Working outside the purpose of stay

Law, Article 37 states that foreigners who stay or reside in China shall not engage in activities not corresponding to the purpose of stay or residence. Law, Article 41 states that foreigners who work in China shall obtain work permits and work-type residence permits, and that no entity or individual shall employ foreigners who have none; Article 43 lists working without them, working beyond the scope of the permit, and foreign students working beyond the scope of jobs or the time limit set under the work-study administration regulations among the acts deemed unlawful employment. Order No. 42, Article 30 states that international students may take part in work-study while studying at a higher education institution but may not take employment, engage in business or carry out other profit-making activities. The Embassy of the People's Republic of China in the United Kingdom, in Part Seven of its visa pages, answers Q12 by saying that foreign citizens must not engage in activities other than the stated purpose of the visit in the visa application form, or activities requiring approval, and that anyone seeking to work in China needs to apply for a work permit; that answer is this embassy's statement for applicants in the UK.

Internships written into the course

Order No. 42, Article 20 requires higher education institutions to organise teaching internships and social practice for international students according to the teaching plan and to follow national rules when choosing the locations, and Article 3 of the 2021 work-study measures excludes internships and social practice organised by the school under the teaching plan from the definition of work-study. Neither article addresses whether a short-term student may take part, and neither article states any procedure for X2 holders; the school that admitted you is the body to ask.

Can I do any paid work at all on an X2 visa?

The route the documents describe for paid work-study runs through a study-type residence permit with an endorsement, and Article 9 of the 2021 measures requires more than six months of remaining validity plus more than a year of continuous study; an X2 holder holds a visa, not a residence permit, for study of not more than 180 days. Order No. 42, Article 30 separately states that international students may not take employment, engage in business or carry out other profit-making activities.

Can I extend my stay and then apply?

Under Law, Article 29, an extension of a stay of no more than 180 days must be applied for seven days before the duration expires, and the accumulated extension shall not exceed the original duration of stay in the visa. Article 22 of the Regulations and Article 9 of the 2021 measures are written in terms of a residence permit for study, not of an extended visa stay; neither article sets out a way to move from one to the other.

Does my school decide whether I can work?

The school makes its own implementing rules for work-study and sets additional conditions (2021 measures, Articles 4 and 9(6)), and it cancels work-study eligibility in the cases listed in Article 13. Those rules operate inside the conditions the measures set, including the residence permit requirement in Article 9(2).
