Extending a residence permit for study: apply within the last 30 days

To extend a study residence permit when your course continues, you apply to the exit and entry administration of the public security organ under the local people's government at or above the county level, in your place of residence, within 30 days before the current permit expires. If the reasons for the extension are found appropriate and sufficient, the period of residence is extended. If the extension is denied, you leave China on the expiry of the validity period specified in your residence permit, and that refusal decision is final (Law, Articles 32 and 36).

Where and when the application goes in

The 30-day window is set by the Law and repeated in the Administration's own English service guide (page dated 1 April 2021): the applicant "shall submit an application to the exit and entry departments of public security organs under a local people's government at or above the county level in the place of residence 30 days before the expiration of the validity period of the residence permit".

Two things the official texts do not say: they do not say what happens to an application filed earlier than 30 days before expiry, and they do not set out a procedure for applying after the permit has already expired. Treat the 30-day period as the one stated window and confirm timing with the office handling your case.

What you have to submit

Regulations Article 17 sets the base list for any extension, change or reissuance of a residence permit:

  • a completed application form;
  • your passport or other international travel documents;
  • qualified photos;
  • material relating to the purpose of the application.

What counts as purpose material for study comes from the service guide. For a person who entered on an X1 visa, the study category requires a letter from the school stating the period of study, plus proof of admission or enrolment; where the relevant information has already been registered through the national information system for managing study in China, the guide allows the paper materials to be waived. A person who entered on another type of visa must also submit certification material issued by the competent department (Chinese service guide, section on study-category residence permits).

The extension section of the guide adds that an applicant submits the relevant supporting material, or certification material covering a change in personal details or in the purpose of residence, in line with those provisions, after which the residence period may be extended and a new permit issued.

After you file: the acceptance receipt

Regulations Article 18 covers what happens once your application is accepted:

  • The exit and entry administration issues a receipt of acceptance valid for a period not exceeding 15 days, and makes its decision within the validity period of that receipt. The Regulations text says "15 days"; it does not state whether these are working days or calendar days.
  • If your procedures or material do not conform to the provisions, the authority must notify you, in a one-off manner, of the procedure to follow and the material to be supplemented or corrected.
  • While your passport or other international travel document is retained for processing, you may reside in China legally on the strength of the receipt of acceptance.

So a pending application is not a gap in lawful residence: the receipt itself covers the period in which the passport is held by the office.

If the extension is refused

The Law is direct. Article 32 states that where an extension is denied, the foreigner concerned shall leave China on the expiry of the validity period specified in the residence permit. Article 36 states that a decision by the exit and entry administration "on rejecting applications for visa extension or reissuance, or on not issuing foreigners' stay or residence permits or not extending the duration of residence shall be final".

Neither the Law nor the Regulations set out any further review of such a decision in the provisions supplied here. The English service guide phrases the consequence slightly differently — that the foreigner "shall leave China before the expiry of the residence certificate" — while the Law ties departure to the expiry of the permit's validity period.

Fees printed in the service guide

Both the Chinese guide and the Administration's English guide print the same three charging bands, citing the notice of the National Development and Reform Commission and the Ministry of Finance on charging standards for foreigners' residence permits (Fa Gai Jia Ge [2004] No. 2230 / 发改价格〔2004〕2230号):

The English page (dated 1 April 2021) also lists three further items: the same standards apply to every accompanying person added to a permit; removing an accompanying person costs CNY 200 per person per time; and an information change costs CNY 200 per person per time. The Chinese guide's charging section lists only the three validity bands.

The charging section does not distinguish between a first permit and an extension. These are the figures printed in the guide; a local office's current notice prevails if it differs. The Chinese guide also carries no date of its own — its address sits in the Administration's March 2019 folder — so it is worth checking the fee board at the office that takes your application.

Questions people ask

When exactly should I apply?

Within 30 days before the residence permit expires, at the exit and entry administration of the public security organ in your place of residence (Law, Article 32; Administration's English service guide). The texts give no other window for an extension application.

Can I stay in China while the application is being decided?

Yes, on the strength of the acceptance receipt. Regulations Article 18 states that during the period when your passport or other international travel document is retained for processing, you may reside in China legally on the basis of that receipt.

What documents are needed for a study extension?

Regulations Article 17 lists the application form, passport or other international travel documents, qualified photos and purpose-related material. For study, the service guide's study category names the school letter stating the period of study and proof of admission or enrolment, with paper material waivable where the information is already registered in the national system.

How long the decision takes?

Regulations Article 18 says the acceptance receipt is valid for a period not exceeding 15 days and that the decision is made within the validity of that receipt. The Regulations do not state whether those days are working days, and the service guide gives no separate processing time for an extension.

What happens if my extension is refused?

You leave China on the expiry of the validity period specified in your residence permit (Law, Article 32), and the refusal decision is final (Law, Article 36).

Does a refused extension mean I can reapply or appeal?

The supplied texts do not provide for either. Law Article 36 states that the decision not to extend the duration of residence is final, and no further review procedure appears in the Law, the Regulations or the service guide.
