Residence permit for study and study visa: two documents, two jobs

Your student visa and your residence permit for study are two separate documents, issued by two different authorities at two different points in your journey. The visa is issued before you travel, by a Chinese visa-issuing authority stationed abroad, and it is the document that gets you into the country (Law, Article 15). The residence permit is issued after you arrive, by the exit/entry administration of the public security organ in the place where you will reside, and it is the document that lets you stay (Law, Article 30; Regulations, Article 15(2)).

Who issues each document, and when you apply
For entry, the Law requires foreigners to apply to the visa-issuing authorities stationed abroad for a visa, unless the Law provides otherwise (Law, Article 15). Applicants submit their passport or other international travel document and the information of the specific application matter to those authorities, go through the formalities, and accept interviews as those authorities require (Law, Article 18). Where the visa authority asks for a written invitation from an entity or individual in China, the applicant provides it, and the entity or individual issuing the invitation is liable for the fidelity of its contents (Law, Article 19).
The Regulations add that visa authorities abroad may, with the approval of the Ministry of Foreign Affairs, entrust local institutions with services such as receiving visa application material, data input and consultancy (Regulations, Article 37). Those are the services the article lists.
The residence permit is handled on Chinese territory. Where the visa held by a foreigner specifies that a residence permit is needed after entry, the holder applies, within 30 days from the date of entry, to the exit/entry administration of the public security organ under the local people's government at or above the county level in the proposed place of residence (Law, Article 30).
What each document records
The two lists of registered items overlap but are not the same. Both record name, sex, date of birth, date and place of issuance, and the passport or other international travel document number (Law, Articles 17 and 33).
The visa additionally records its type, the number of allowed entries, the validity period of entry and the duration of stay (Law, Article 17). The residence permit instead records the reason for residence and the duration of residence (Law, Article 33). The permit's registered items do not include a number of allowed entries, and the visa's registered items do not include a reason for residence as such.
If a registered item on a residence permit changes, the holder applies to the exit/entry administration of the public security organ in the place of residence for alteration, within 10 days from the date of change (Law, Article 33).
How long each document is valid
For the visa, the Law only says that the validity period of entry and the duration of stay are items recorded on it (Law, Article 17). The texts used on this page set no numerical minimum or maximum for a visa.
For residence permits, the Law gives two ranges: 90 days at the minimum and five years at the maximum for a work-type permit, and 180 days at the minimum and five years at the maximum for a non-work-type permit (Law, Article 30). The Regulations list the study permit as a type of its own, separate from the work permit (Regulations, Article 15), which places it outside the work-type range; the two texts used here do not state this in express terms. The Law also says the exit/entry administration issues the appropriate type of permit with the duration, based on the purpose of residence (Law, Article 30).
Travelling out of China and coming back
A visa records the number of allowed entries (Law, Article 17), so the visa itself carries that limit.
For a residence permit, the Law lists holding a valid foreigner's residence permit as one of the circumstances in which a foreigner may be exempt from applying for a visa (Law, Article 22(2)). The other circumstances listed are visa exemption agreements signed by the Chinese government with other governments, transit on a connected ticket to a third country or region under the stated conditions, and other circumstances stipulated by the State Council (Law, Article 22). The texts used here do not record any number of entries on a residence permit.
The five types of residence permit
Regulations, Article 15 divides residence permits into five types:
- Work — issued to persons who work in China.
- Study — issued to persons who pursue long-term studies in China.
- Journalists — issued to resident foreign journalists of permanent offices of foreign news agencies in China.
- Reunion — issued to family members of Chinese citizens and family members of foreigners with permanent residence status in China who need to reside in China for family reunion, and to persons who need to reside in China for fosterage or other purposes.
- Personal matters — issued to spouses, parents, children under the age of 18 or parents-in-law of foreigners residing in China for work, study or other purposes who apply for long-term visit to China, and to persons who need to reside in China for other personal matters.
Study is type (2). The Regulations use the phrase "long-term studies" without defining it, and the texts supplied here do not say how a given programme or enrolment maps onto that phrase.
Applying for the residence permit after you arrive
Take your passport or other international travel document.
Prepare the information for the specific application matter.
Provide biometric identification information, such as fingerprints.
File the application at the exit/entry administration of the public security organ in your place of residence.
Do this within 30 days of the date of your entry, if your visa says a residence permit is required.
The administration then examines the application and makes a decision within 15 days of the date of receipt, and issues the appropriate type of permit with the duration, based on the purpose of residence (Law, Article 30).

What these two texts do not say
The Law and the Regulations, as published by the National Immigration Administration, do not contain a fee schedule, a document checklist, or a processing-time commitment for either application. The only deadline they set for a decision is the 15-day examination period for a residence permit application (Law, Article 30). Neither text states how many entries a residence permit allows, defines "long-term studies", or says which authority decides a visa application in so many words; the Law only describes what applicants submit to the visa-issuing authorities stationed abroad (Law, Article 18).
Two notes on the versions used. The English texts quoted here are those published on the National Immigration Administration website, on pages dated 10 March 2021. The Law was adopted on 30 June 2012 and came into force on 1 July 2013 (Law, Article 93); the Regulations are State Council Decree No. 637, promulgated on 12 July 2013 and in force from 1 September 2013. Separately, in the English text of the Regulations, Article 18 uses the phrase "whether to issue the visa" in the sentence dealing with residence permit applications; this page reads that as the decision on the application.
Questions people ask
Do I have to apply for a residence permit?
Only if your visa specifies that you need one after entry. Where it does, the Law requires you to apply within 30 days from the date of your entry, to the exit/entry administration of the public security organ in your proposed place of residence (Law, Article 30).
How long does the exit/entry administration take to decide?
The Law requires the exit/entry administration to conduct examination and make a decision within 15 days from the date of receipt of the application (Law, Article 30). The text sets no other time limit.
Do I have to give fingerprints?
Yes. Applicants for a foreigner's residence permit are required to provide biometric identification information such as fingerprints (Law, Article 30).
Can I re-enter China without a new visa if I hold a residence permit?
The Law lists holding a valid foreigner's residence permit as a circumstance in which a foreigner may be exempt from applying for a visa (Law, Article 22(2)). The texts used here do not attach a number of entries to a residence permit.
What if something recorded on my permit changes?
Apply to the exit/entry administration of the public security organ in your place of residence to go through the alteration formalities, within 10 days from the date of the change (Law, Article 33).
How long can my student visa be valid?
The Law provides that the validity period of entry and the duration of stay are items recorded on the visa (Law, Article 17), but the texts used here give no minimum or maximum figure for a visa.
