Who issues a Chinese study visa and who decides: missions, entrusted centres and border inspection

Three different bodies decide three different things. The visa authority stationed abroad — a Chinese diplomatic or consular mission — examines your application and issues the appropriate category of visa (Regulations, Article 9). Entrusted local institutions, where a mission uses them with the Ministry of Foreign Affairs' approval, handle receiving application material, data input and consultancy, and nothing more as far as the Regulations go (Regulations, Article 37). At the port, the exit/entry border inspection authority decides whether you are allowed in (Law, Article 24; the Embassy of the PRC in the United Kingdom, FAQs and Answers, Q13).

The visa authority abroad issues the visa

Foreigners entering China apply to the visa authorities stationed abroad for a visa, except where the Law itself provides otherwise (Law, Article 15). Visas fall into diplomatic, courtesy, official and ordinary categories; for reasons other than diplomatic or official ones — the Law lists work, study, family visit, travel, business activities and talent introduction — an appropriate type of ordinary visa is issued, and the types of ordinary visa and their issuance measures are stipulated by the State Council (Law, Article 16).

On examination, if the visa authority deems the applicant eligible, it issues the appropriate category of visa; where the applicant needs to obtain a residence permit after entry, the visa authority specifies on the visa the time limit for applying for that permit after entry (Regulations, Article 9). That is the whole of what the Regulations say about the decision itself.

Applicants submit their passport or other international travel document and the information of the specific application matters, go through the formalities and accept interviews in accordance with the requirements of the visa authority abroad (Law, Article 18). Where a written invitation from an entity or individual in China is required, the applicant provides it as the visa authority requires, and the entity or individual issuing it is liable for the fidelity of its contents (Law, Article 19).

The Embassy of the PRC in the United Kingdom states on its own visa page that Chinese diplomatic and consular missions, together with other institutions entrusted by the Ministry of Foreign Affairs, are responsible for issuing visas to foreigners in host countries, and that Chinese visa-issuing authorities make the final decision on visa type, number of entries, period of validity and duration of stay. Its FAQ answer puts the same point in one line: the Chinese visa officer decides what type of visa will be issued (Part Seven, Q3). That page is the UK embassy's guide, not a rule published for every mission.

What an entrusted centre does — and what the Regulations do not give it

Regulations, Article 37 is short and exact: with the approval of the Ministry of Foreign Affairs, the visa authorities abroad may entrust local institutions with services such as receiving visa application material, data input and consultancy. Three things follow from the wording.

First, entrusting is optional and conditional — "may entrust", and only with the Ministry of Foreign Affairs' approval. The Regulations do not say which missions use such institutions or which institution is used anywhere.

Second, the services named are administrative and advisory. Article 37 gives an entrusted institution no power to issue a visa, to refuse one or to change the category, number of entries, validity or duration of stay; the Regulations place the decision with the visa authority (Regulations, Article 9), and the Law places the application with the visa authorities stationed abroad (Law, Article 15).

Third, the Regulations say nothing here about other functions. Article 37 does not mention biometrics, fingerprints, fees, courier return or document checking against a checklist. Where a mission publishes such requirements, they are that mission's own instructions.

At the port, border inspection decides entry

A visa does not complete the entry decision. Foreigners entering China submit their passport, other international travel documents, visa or other entry permit to the exit/entry border inspection authority for examination, go through the prescribed formalities, and may enter upon examination and approval (Law, Article 24).

The Law then lists the cases in which entry is not allowed: holding no valid exit/entry documents, or refusing or evading border inspection; falling under Subparagraphs (1) to (4) of the first paragraph of Article 21, which is cross-referred but not quoted in the text used here; possibly engaging in activities that do not conform to the type of visa after entry; and other circumstances in which laws or administrative regulations do not allow entry (Law, Article 25). The third of these is the one that bears directly on students: the category printed on the visa limits what you may do after arrival. A foreigner denied entry is ordered to return, and may be forced to return; while waiting, the person may not leave the restricted zone (Law, Article 26).

The UK embassy's FAQ states the same boundary in plainer terms: after you obtain a visa you should be able to enter through a port open to foreign citizens, but it is up to the border authority to decide whether a specific visa holder can enter China (Part Seven, Q13). The border inspection authority is not required to give reasons for denying entry (Law, Article 25).

What the visa records

The registered items of a visa are the visa type, name, sex, date of birth, number of allowed entries, validity period of entry, duration of stay of the holder, date and place of issuance, and passport number or other international travel document number (Law, Article 17). Those items are the record of what the visa authority decided. Where a residence permit is needed after entry, the time limit for applying for it is specified on the visa itself (Regulations, Article 9). The format of visas is prescribed by the Ministry of Foreign Affairs in conjunction with the Ministry of Public Security, while the formats of stay permits and residence permits are prescribed by the Ministry of Public Security (Regulations, Article 38).

What the quoted official texts do not say

The Exit and Entry Administration Law speaks of "foreigners" generally; it names foreign students in Articles 42, 43 and 45, which are not part of the text quoted here. Neither the Law nor the Regulations text used here uses the labels X1 or X2 — those categories come from the issuance measures and from mission instructions, not from these articles. No fee and no processing time appear in the material quoted on this page; where a mission publishes its own fees or working days, that is that mission's statement. Nothing here states or implies an approval or refusal rate, and no outcome can be promised.

Questions people ask

Who decides which type of visa I am given?

The visa officer. The Regulations say the visa authority issues the appropriate category (Regulations, Article 9), the Law leaves the types of ordinary visa and their issuance measures to the State Council (Law, Article 16), and the UK embassy's FAQ states directly that the Chinese visa officer decides what type of visa will be issued (Part Seven, Q3). Can a visa application centre refuse my application?

The Regulations do not give it that power. Article 37 entrusts local institutions, with the Ministry of Foreign Affairs' approval, with receiving visa application material, data input and consultancy. The decision on the application belongs to the visa authority (Regulations, Article 9).

If I hold a valid visa, am I guaranteed entry?

No. The Law makes entry conditional on examination and approval by the border inspection authority (Law, Article 24) and lists the grounds on which entry is not allowed, including the possibility that the traveller may engage in activities not conforming to the type of visa (Law, Article 25). The UK embassy's FAQ says the border authority decides whether a specific visa holder can enter China (Part Seven, Q13).

Does the visa tell me when to apply for the residence permit after arrival?

Yes, where a residence permit is needed after entry: the visa authority shall specify on the visa the time limit for applying for it (Regulations, Article 9). The article states the duty but not a number of days. For the steps after landing, see the residence permit for study after arrival.

Do I have to attend an interview?

If the visa authority requires one. Applicants go through the relevant formalities and accept interviews in accordance with the requirements of the visa authorities stationed abroad (Law, Article 18). The Law does not set criteria for when an interview is required.

Will the border authority explain a refusal of entry?

Not necessarily. The Law states that exit/entry border inspection authorities are not required to give reasons for denying entry (Law, Article 25).
